This Terms of Service Agreement (the "Agreement") is a legally binding contract between you ("User," "you"), and TextableAI (the "Company," "we," "us"). This Agreement governs your use of the TextableAI service (the "Service") which allows you to interact with OpenAI's GPT technology through SMS or WhatsApp. By using this Service you acknowledge and agree that you are solely responsible for your use of the GPT technology and that your use of the GPT technology must comply with OpenAI's requirements and restrictions, as may be updated at their discretion at any time.

1. Acceptance of Terms

By using the Service, you agree to be bound by the terms of this Agreement. If you do not agree with these terms, you should not use the Service.

2. Use of Service

The Service is provided for your personal and non-commercial use. You must use the Service in compliance with all applicable laws and regulations. You are solely responsible for any content or information that you transmit using the Service.

Our Services are intended for users 13 years of age or older. If you are under 13 years of age, you are not permitted to use the Services. By accessing or using the Services, you represent and warrant that you are 13 years of age or older.

You agree to receive incoming text messages (SMS) from our Services. Message and data rates may apply.

Pro features: You will be able to use all the pro features after you purchase a subscription. The details of the pro features are available on the pricing page.

Refund policy: We allow refunds within 14 days of purchase.

Interruptions of service: Interrupted Services are not guaranteed. We will try our best to keep the Service up and running, but we cannot guarantee the availability of the Service. In the event of natural disasters, change of owners, dependency service outages, and other reasons that make us unable to keep the Service running, you will not be refunded (unless your purchase is still within the 14-day refund period).

3. Intellectual Property

You acknowledge and agree that TextableAI is the sole and exclusive owner of all intellectual property rights, including all copyrights, patents, trademarks, and trade secrets, associated with the Service.

4. Prohibitions

You agree not to use the Service to:

a. Transmit any content or information that is defamatory, libelous, obscene, or otherwise objectionable;
b. Transmit any content or information that infringes on the intellectual property rights of others;
c. Engage in any illegal or fraudulent activities;
d. Download, copy, or distribute any of the content or information on the Service for any purpose other than personal, non-commercial use;
e. Access or attempt to access unauthorized parts of the Service or breach any security measures.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE COMPANY MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT OF THIRD-PARTY RIGHTS.

6. Limitation of Liability

THE COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR USE OF THE SERVICE, INCLUDING, BUT NOT LIMITED TO, LOST DATA, LOST PROFITS, OR ANY OTHER DAMAGES, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Indemnity

You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents, from any claims, damages, losses, or expenses (including attorneys’ fees) arising out of your use of the Service, your violation of this Agreement, or your violation of any rights of another.

8. Termination

We reserve the right to terminate your account and access to the Service at any time, without notice or liability for any reason whatsoever.

9. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, without giving effect to its conflict of laws provisions. You agree that any dispute arising out of or in connection with this Agreement shall be brought exclusively in the federal or state courts located in the State of Washington.

10. Entire Agreement

This Agreement constitutes the entire agreement between you and us and supersedes all prior or contemporaneous communications and proposals, whether oral, written, or electronic, between you and us with respect to the Service.

11. Modifications to Agreement

We reserve the right to modify this Agreement at any time by posting the modified terms on the Service. Your continued use of the Service after such changes have been posted indicates your acceptance of the modified terms.
